Image Licence Terms

Partner Photo Library: Image Licence Terms. Effective 17 September 2026.

In short: the photos are for presenting journeys arranged through Ahipara to your clients. Credit them when you publish them, don’t pass the files on or alter what they show, don’t use them for AI or for travel booked elsewhere, and delete them if your access ends. Every download is recorded against your account. The full terms below are what apply.

  1. 1.Agreement

    1.1These terms are a binding agreement between Ahipara Limited ("Ahipara", "we", "us") and the person holding a Partner Photo Library account and the travel business they represent ("you"). By applying for an account, signing in, or downloading or using any Image, you accept these terms and confirm that you have authority to accept them on behalf of that business.

    1.2If you do not accept these terms, you must not access the library or use any Image.

  2. 2.Definitions

    2.1In these terms:

    1. (a)"Images" means the photographs, and any copies, crops, resizes or derivatives of them, made available through the Partner Photo Library.
    2. (b)"Rights Holders" means the lodges, operators, photographers and other persons who own copyright in Images and have permitted Ahipara to make them available.
    3. (c)"Permitted Purpose" means promoting and selling New Zealand travel arranged through Ahipara to your clients and prospective clients, as described in clause 4.
  3. 3.Ownership and copyright

    3.1The Images are protected by copyright under the Copyright Act 1994 (New Zealand) and by the laws of other countries through international treaties, including the Berne Convention. Copyright in each Image is owned by Ahipara or by the relevant Rights Holder.

    3.2Nothing in these terms transfers ownership of any Image or any intellectual property right to you. All rights not expressly granted to you are reserved by Ahipara and the Rights Holders.

  4. 4.Your licence

    4.1Subject to your continued compliance with these terms, Ahipara grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable and royalty-free licence to download, reproduce and display the Images solely for the Permitted Purpose, for as long as your account remains approved.

    4.2Within the Permitted Purpose, you may use Images in:

    1. (a)client proposals, itineraries and presentations for journeys arranged through Ahipara;
    2. (b)correspondence with clients and prospective clients about those journeys; and
    3. (c)your own business’s website pages, newsletters and social media posts that promote journeys arranged through Ahipara, provided each use carries the credit set out in clause 6.
  5. 5.Restrictions

    5.1You must not, and must not permit anyone else to:

    1. (a)sell, license, sublicense, lend, give away or otherwise make any Image available to a third party as a stand-alone file, including through a stock library, image bank, or a shared drive or folder accessible to people outside your business;
    2. (b)use any Image to promote or sell travel, accommodation or experiences that are not arranged through Ahipara, including booking a featured property or operator directly;
    3. (c)alter, distort, retouch, combine or edit any Image beyond reasonable cropping and resizing, or in any way that misrepresents a property, experience, place or person;
    4. (d)remove, obscure or alter any copyright notice, credit, watermark or embedded metadata;
    5. (e)use any Image in paid advertising, printed material, outdoor or broadcast media, or on merchandise or products for sale, without our prior written consent;
    6. (f)use any Image as, or as part of, a trade mark, logo or brand identity;
    7. (g)use any Image, or allow it to be used, to train, fine-tune, test or prompt any artificial intelligence or machine learning system, or to create synthetic or AI-generated images;
    8. (h)use any Image in a manner that is unlawful, defamatory, misleading or offensive, or that implies that a person depicted, a Rights Holder or Ahipara endorses you, your business or any product or service;
    9. (i)use any Image depicting Māori cultural practices, taonga or places of significance other than respectfully, in its original context, and without alteration; or
    10. (j)register, or claim, any copyright or other right in any Image.
  6. 6.Credits

    6.1Wherever an Image is published outside a private client proposal, you must credit it as "Image courtesy of Ahipara Luxury Travel", together with the Rights Holder’s name where we have supplied one, in a position reasonably associated with the Image.

  7. 7.Your account

    7.1Accounts are personal to the approved individual. You must keep your password confidential, must not share your account, and are responsible for all activity under it. You must tell us promptly at info@ahipara.com if you believe your account has been used without your authority.

    7.2Ahipara may approve, decline, suspend or close any account at its discretion, at any time and without giving reasons.

  8. 8.Download records and privacy

    8.1We record activity on your account, including your application details, the dates and times you sign in, and each Image you download together with the date and time of the download.

    8.2We use these records to administer your account and this licence, to protect the Rights Holders, and to enforce these terms, and we may share relevant records with a Rights Holder for those purposes. We handle personal information in accordance with the Privacy Act 2020 and our privacy policy at https://ahipara-luxury-travel.vercel.app/privacy. By using the library, you consent to these records being kept and used in this way.

  9. 9.Termination and removal

    9.1Your licence ends automatically and immediately if you breach these terms, if your account is declined, suspended or closed, or if your business ceases to work with Ahipara.

    9.2When your licence ends, you must stop using the Images and, within 14 days, delete all copies in your possession or control. Copies contained in proposals already sent to clients before the licence ended may be retained for record-keeping, but must not be used again.

    9.3We may ask you at any time to stop using a particular Image (for example, where a Rights Holder withdraws its permission). You must do so, and delete all copies of that Image, within 7 days of our request.

  10. 10.No warranties

    10.1Images are provided "as is". They may not reflect the current condition, season, availability or features of any property, experience or place, and you are responsible for ensuring that your use of an Image does not mislead your clients.

    10.2We do not warrant that any Image is free of the rights of third parties, such as people depicted, trade marks, artworks or architecture. Model and property releases are not supplied. Any use beyond the Permitted Purpose is at your sole risk.

  11. 11.Liability and indemnity

    11.1To the maximum extent permitted by law, Ahipara and the Rights Holders are not liable to you for any indirect, incidental or consequential loss, or for any loss of profit, revenue, business or goodwill, arising out of or in connection with the library, the Images or these terms, and Ahipara’s total liability to you under or in connection with these terms is limited to NZD $100.

    11.2You acquire access to the library for the purposes of a business. The Consumer Guarantees Act 1993 does not apply, and, to the extent permitted by section 5D of the Fair Trading Act 1986, you agree that sections 9, 12A and 13 of that Act do not apply to these terms.

    11.3You indemnify Ahipara and the Rights Holders against all claims, losses, damages, costs (including legal costs on a solicitor–client basis) and liabilities arising out of any breach of these terms by you or any use of an Image by you or your business outside the Permitted Purpose.

  12. 12.Infringement

    12.1Any use of an Image that is not permitted by these terms may infringe copyright. Remedies for infringement under the Copyright Act 1994 include damages, an account of profits and injunctions. Ahipara and the Rights Holders reserve all of their rights and remedies, and we may disclose your identity and download records to a Rights Holder to enable them to enforce their rights.

  13. 13.Changes

    13.1We may update these terms from time to time. The version in force is the one published at the time of use, identified by its effective date. If we make a material change, we will let you know by email, and your continued use of the library or the Images after that notice constitutes acceptance of the updated terms.

  14. 14.General

    14.1These terms are governed by the laws of New Zealand, and you submit to the exclusive jurisdiction of the courts of New Zealand.

    14.2These terms apply alongside any other written agreement between you and Ahipara; if there is a conflict concerning the Images, these terms prevail unless that agreement expressly says otherwise.

    14.3If any provision of these terms is held to be invalid or unenforceable, it will be severed and the remaining provisions will continue in full force. A failure or delay by Ahipara in exercising any right is not a waiver of it. You may not assign or transfer any of your rights under these terms.

    14.4Notices to Ahipara must be sent to info@ahipara.com.
